The Supreme Court’s Role in Foreign Affairs

Should the Supreme Court play a more active role in the conduct of U.S. foreign policy?  Drawing upon constitutional history, international relations theory, and legal doctrine, this lecture will consider to what extent the judicial branch of the federal government has the power and duty to apply the law as it pertains to international affairs without deference to the executive and legislative branches.  This course draws upon the instructor’s recently published book, Restoring the Global Judiciary (Princeton University Press, 2019).
